The arrest of individuals such as Maulana Ataur Rahman Bikrampuri, the issuance of detention orders, and their prolonged imprisonment without judicial process have generated intense concern, resentment, and serious questions across the country. According to human rights activists, lawyers, intellectuals, and conscious members of civil society, such measures are not merely an assault on personal liberty; rather, they constitute a clear violation of the rule of law, constitutional rights, and internationally recognized human rights standards.

The Constitution of Bangladesh recognizes personal liberty, justice, and access to legal remedy as fundamental rights of its citizens. At the same time, under the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR), it is a mandatory obligation of the state that any person who is arrested or detained must be promptly produced before a judicial authority and given the opportunity for a fair trial. Yet, in the current reality, it is evident that by exercising administrative powers such as detention orders, certain individuals are being effectively pushed into imprisonment without trial, which serves as an ominous signal for a democratic state.
According to human rights analysts, preventive detention is essentially an exceptional measure, applicable only in extremely limited circumstances and for a short duration. However, when this mechanism is routinely used as a tool to suppress political or ideological dissent, it fundamentally calls into question the legal legitimacy of the state itself. In cases involving individuals like Maulana Ataur Rahman Bikrampuri, allegations of prolonged detention without trial have emerged as a clear example of the abuse of state power.
In this context, the issue becomes even more sensitive due to the recurrence of such incidents under the governance of a Nobel Peace Prize laureate like Dr. Muhammad Yunus. Globally recognized as a symbol of peace, human dignity, social justice, and poverty alleviation, allegations of detention without trial and custodial repression under his administration damage not only the country’s image domestically but also its standing in the international arena. Human rights activists argue that the public expects a more humane, tolerant, and law-abiding approach from a governance system led by a Nobel Peace Prize laureate; instead, such harsh and controversial measures generate deep disappointment.
According to legal experts, detaining individuals for long periods without judicial process is not only a violation of human rights; it also erodes public trust in the justice system and pushes the state toward a repressive structure. As a result, political and social divisions deepen further, posing a grave threat to long-term stability and peace.
In this situation, domestic and international human rights organizations, representatives of civil society, and various professional bodies have strongly demanded that those who are being detained and subjected to custodial repression without trial be released immediately, without any delay. At the same time, they have called for an end to the abuse of detention orders, the assurance of an independent and impartial judicial process, and full transparency in decisions related to arrest and detention.
Human rights activists further believe that if the state truly seeks to uphold democracy, the rule of law, and respect for human rights, it must adopt dialogue, tolerance, and fair justice—not the suppression of dissent—as the guiding principles of state governance. Otherwise, this continuing trend of detention without trial will push the state into a moral crisis and place it in the dock of history.
